Abstract
The present work aims, through the analysis of the structure of both the Civil Contract and the Public Deed, know better the elements that make them up and that give them validity. Study the causes that cause the nullity of either of these two figures, that they have so much importance in the legal world, especially in the matter of obligations and to be able to differentiate the nullity and the effects of this, for the contract as well as for the Public Deed.
Analyzing the regulations that regulate them, -fundamentally- the Civil Code and the Notarial Law, the doctrine and concepts given by jurists of the matter, we will be able to better address nullity as a central topic of study in this work; since the nullity to which both the Contract and the Deed may be subject carry some consequences for both elements. In addition to the fact that such consequences will also depend on the type of nullity to which they are subject, since it can be absolute or relative.
Resumen
El presente trabajo pretende, mediante el análisis de la estructura tanto del Contrato civil como de la Escritura Pública, conocer mejor los elementos que los conforman y que les dan validez. Estudiar las causas que originan la nulidad de cualquiera de estas dos figuras, que tanta trascendencia tienen en el mundo jurídico, en especial en el tema de las obligaciones y poder diferenciar la nulidad y los efectos de esta, para el contrato tanto como para la Escritura Pública.
Analizando la normativa que los regula, -fundamentalmente- el Código Civil y la Ley Notarial, la doctrina y conceptos dados por juristas de la materia, podremos abordar de mejor manera la nulidad como tema central de estudio en este trabajo; pues la nulidad a la que pueden estar sujetos tanto el Contrato como la Escritura conllevan algunas consecuencias para uno y otro elemento. Además de que tales consecuencias dependerán también del tipo de nulidad a la que estén sujetos pues la misma puede ser absoluta o relativa.
