Masculinidades y violencia de género: sentencias condenatorias ejecutoriadas de contravenciones de violencia en la pareja, en la Unidad de Violencia contra la Mujer y Miembros del Núcleo Familiar del cantón Cuenca, año 2019

Abstract

The present research project aims to characterize the influence of masculinities in intimate partner violence in the processes with final convictions of the “Unidad de Violencia contra la Mujer y Miembros del Núcleo Familiar” of Cuenca Canton in 2019 in order to understand the social phenomenon of gender violence. The adopted methodology was a qualitative and quantitative approach with a descriptive scope. The sample was selected based on inclusion, exclusion and sample elimination criteria. The instruments used were the individual digital databases of the Expert Social Workers, information collection form, and computer programs for data collection, tabulation, and processing. And the information gathering was carried out by reading and reviewing the physical files of the judicial processes. The results show us sentencing indicators such as the most recurrent sanction modalities, the protection measures, and reparation mechanisms mostly applied in sentencing according to the “Código Orgánico Integral Penal” as well as the role of Social Work performed in the forensic socio-legal field. On the other hand, the sociodemographic profile characterizes the sex, kinship, age, marital status, education, and occupation of the convicted offenders, their socioeconomic situation, or whether they belong to a priority care group. Lastly, the discourse of the procedural parties collects the types of violence contemplated in the “Ley Orgánica para Prevenir y Erradicar la Violencia contra las Mujeres” as well as the theory of masculinity.
