| Abstract: | The objective of this research is to study the Revocation of the Mandate of
the Council for Citizen Participation and Social Control, this form of cessation was
strengthened in the 2008 Constitution, so that through popular vote, citizens can
exercise their right in the appointment of their authorities. Since that year, the
members of the Cpccs were elected by merit and opposition, but as a result of the
referendum held on February 4, 2018, this modality changed and they must be
elected through the direct democracy mechanism, for this analysis the 2008
Constitution and the laws established by the competent bodies.
In addition, the revocation was addressed in countries such as Venezuela,
Peru, Bolivia, Argentina, Colombia, among others; where this type of process has
been questioned due to the lack of transparency of the authorities.
It has been known what are the reactions that this type of process has
generated in society, in the legislative power and how it has been seen by other
organisms and even some experts already consider that this function called the fifth
power of the State should be eliminated or restructured. |
| Description: | La presente investigación tiene como objetivo estudiar la Revocatoria de
Mandato del Consejo de Participación Ciudadana y Control Social, esta forma de
cesación fue fortalecida en la Constitución del 2008, para que mediante el voto
popular la ciudadanía pueda ejercer su derecho en la designación de sus
autoridades. Desde aquel año los miembros del Cpccs eran elegidos por concurso
de méritos y oposición, pero a raíz del referéndum celebrado el 4 de febrero del
2018, esta modalidad cambió y deberán ser elegidos mediante el mecanismo de
democracia directa, para este análisis se ha revisado la Constitución 2008 y las
leyes establecidas por parte de los organismos competentes.
Además, se abordó la revocatoria en países como Venezuela, Perú, Bolivia,
Argentina, Colombia entre otros; donde este tipo de procesos han sido cuestionados
por la falta de transparencia de las autoridades.
Se ha conocido cuáles son las reacciones que ha generado este tipo de
proceso en la sociedad, en el poder legislativo y cómo ha sido visto por parte de
otros organismos e incluso algunos expertos ya consideran que esta función
denominada el quinto poder el Estado debería ser eliminada o reestructurada. |
