| Abstract: | This research work aims to identify the foundations that enable public administration to
revoke its own administrative acts, once that it becomes final. Following the legal Ecuadorian
system, this work emphasizes the principles that are developed in the Organic Administrative
Code (hereinafter COA), such as lawfulness, efficiency, and effectiveness. Bearing in mind that
these acts are not affected by any kind of vice that invalidates them. In such case, the analysis
includes the concept and the elements that the administrative act is currently invested in the
COA, likewise, the reasons that would justify the revocation of these legitimate administrative
acts. Alike, as a result of the revocation, it is necessary to determine the obligation that the
administration must indemnify, in certain cases, to the person affected by the revocation act.
Finally, it will be established whether the normative foundations correspond to the doctrinal
and lawfulness foundations |
| Description: | El presente trabajo de investigación tiene el objeto de identificar los fundamentos que
habilitan a la administración pública para que pueda revocar sus propios actos administrativos,
que han causado estado. Todo bajo el ordenamiento jurídico que rige en el Ecuador, haciendo
énfasis en los principios que están desarrollados en el Código Orgánico Administrativo (en
adelante COA), como el de juridicidad, eficiencia, y eficacia; teniendo presente que dichos
actos no se encuentran afectados por un vicio que los invalida. En tal caso, se analizará el
concepto y los elementos de que se encuentra investido el acto administrativo actualmente en
el COA. Así también, las razones que justificarán la revocatoria de los actos administrativos
legítimos. Igualmente, a consecuencia de su revocatoria, es necesario determinar la obligación
que tiene la administración para indemnizar, en ciertos casos, a la persona afectada por la
revocatoria. Finalmente, se establecerá si los fundamentos normativos corresponden a los
fundamentos doctrinarios y jurisprudenciales |
