| Abstract: | The purpose of this research is to determine the possible occupational hazards that could happen under the figure of teleworking, because it is an interesting and novel way of activities out of with work place it is a new work modality in the Ecuadorian Legislation, so it’s necessary to clarify and know the different scenarios to face in case that an occupational hazard happens.
For instance, it will be necessary to refer to the internal regulations that talks states about this issue, as well as a comparative analysis with the different laws to solve this problem and a procedure to determine the existence of an occupational hazard and it’s manifestation forms. Teleworking in the Ecuadorian legislation has recently been published, so there is not real rules or regulations on this topic.
The right to occupational health and safety will be analyzed though the Ecuadorian Constitution, as well as the current norms of the ministerial agreements that recognize the figure of teleworking, and those in the Labor Code referring to this modality, and its respective guarantees to make it effective. Finally on analysis about the content of the Colombian and Spanish regulations will be in place, since both laws are pioneering in the field of teleworking, it will be of great help in order to establish the casuistry of occupational risks that could arise in this labor figure |
| Description: | La presente investigación y estudio tiene como finalidad determinar los posibles riesgos laborales que podrían suscitarse bajo la figura del teletrabajo, puesto que, al ser una novedosa forma de ejecución de actividades laborales practicadas en un lugar no habitual de trabajo, y al ser una modalidad nueva dentro de la legislación ecuatoriana, es necesario esclarecer dicho particular, y así poder conocer los distintos panoramas a enfrentarnos en caso de que aquello acontezca.
Para ello, será necesario remitirnos a la normativa interna que aborda el presente tema, así como también, un análisis comparativo con las distintas legislaciones que tienen un tratamiento para este problema y un procedimiento mediante el cual pueden determinarse la existencia o no de un riesgo de trabajo, sus manifestaciones y formas existentes. Al ser de reciente data la inclusión del teletrabajo en la legislación ecuatoriana, no existe una verdadera regulación y reglamentación acerca de esta temática.
Analizaremos la Constitución de la República del Ecuador referente al derecho a la seguridad e higiene laboral, así como también las normas vigentes de los acuerdos ministeriales que reconocen la figura del teletrabajo, y las contenidas en el Código del Trabajo referente a esta modalidad, y sus respectivas garantías para hacerlo efectivo. Finalmente se estará al contenido de la normativa colombiana y española, puesto que al ser ambas legislaciones pioneras en materia de teletrabajo, será de suma ayuda para efectos de establecer la casuística de los riesgos laborales que podrían suscitarse en esta figura laboral |
