El femicidio cantón Cuenca: Análisis de la aplicación del tipo penal femicidio por los/as operadores/as de justicia en los procesos legales, periodos 2014-2016

Abstract

This research work analyzed the application of the femicide criminal type by the justice operators of the Canton Cuenca Province of Azuay, in the periods 2014-2016. The main research is to identify the three components of law, formal regulatory component, structural component and political-cultural component, methodology proposed by Alda Facio (2009). The research compiled concepts that support the need for the typification of femicide. International instruments that are the basis of the legal framework and gave rise to the definition of femicide are also presented. The speeches of the legislative debate, the social reaction, the non-governmental organizations explained why to address, prevent and eradicate the most extreme violence committed against women. The investigation shows how the judicial system makes women's rights invisible, as a result the justice operators are unaware of the specific forms of violence against women. An insensitive institutional structure that minimizes the treatment of violence. This results in an inactive judicial system that transfers responsibility for the evidence to the next of kin of the victims and to the surviving victims without assessing the seriousness of the problem.
