La aplicación del debido proceso en el procedimiento directo y su influencia en la ciudad de Cuenca

Abstract

This research paper contains an analysis of the article 640 of Integral Criminal Code (COIP) which regulates the rules of the direct procedure, which also analyzes if it complies with the basic guarantees of due process, especially the right to defense, the right to have reasonable time to prepare the defense, the principle of equality of arms, among others. In the same way, the aim of this research paper is analyze the judicial processes applied by this special procedure in which it will be verified if it complies with the constitutional and international parameters referred to in the preceding paragraph. Finally, there will be several interviews to prosecutors, judges and trial lawyers in order to know their criteria and generate a conclusion that satisfies the objective of this investigation.
