The present investigation analyzes the different ways to constitute and extinguish a right of usufruct within our legal system with the purpose of guaranteeing to a third party called usufructuary the right to be able to use and enjoy something that belongs to another, as if it were the same Owner of said property without being disturbed by any person.
So for your better understanding we will start from the concept of the right of usufruct.
It is also necessary to determine the different ways that the owner of a property can constitute a right of usufruct in favor of any person on movable or immovable property.
We will also address the ways in which the usufruct right can be terminated.
We will briefly analyze comparative law as the Chilean and Colombian legislation. Finally, we will conclude with Ecuadorian jurisprudence on a case study on the constitution of usufruct on movable and immovable property, as well as how to constitute and extinguish the right of usufruct in daily practice.

La presente investigación analiza las diferentes maneras de constituir y extinguir un derecho de usufructo dentro de nuestro ordenamiento jurídico, con la finalidad de garantizar a un tercero llamado usufructuario el derecho de poder usar y gozar de una cosa que pertenece a otro, como si fuera el mismo propietario de dicho bien sin que sea perturbado por persona alguna.
Por lo que para su mejor comprensión partiremos del concepto del derecho de usufructo.
Asimismo, es necesario determinar las diferentes maneras que el propietario de un bien puede constituir un derecho de usufructo a favor de cualquier persona sobre bienes muebles o inmuebles.
Abordaremos también las maneras por las que se puede extinguir el derecho de usufructo.
Analizaremos brevemente el derecho comparado como la legislación chilena y la colombiana. Finalmente concluiremos con jurisprudencia ecuatoriana en torno a un caso práctico sobre la constitución del usufructo sobre bienes muebles e inmuebles, como también la forma de constituir y extinguir el derecho de usufructo en la práctica diaria.
