| Abstract: | Since very remote times, the ways through which a marriage can be terminated has been regulated, in that the divorce has been a very important figure.
This monographic work has as an object to study, in general terms, the divorce and the proceedings, for those that are found regulated in our standing legal framework, in which it has established a preponderantly oral system for the trial proceedings in all of its instances, stages, and diligences except for the procedural acts that must be made in writing.
The present investigation aspires to provide to the society a knowledge about the actual standing proceedings for the termination of a marriage. To do so, a divorce study has been conducted as one of various ways to terminate the marriage bond, in order to determine, in each case, which would be the correct path to follow to obtain it, in doing so, it has been taken in consideration the amendments fulfilled the Civil Code and the General Organic Code of Processes, doctrine, with the understanding to give an updated vision in order that, students, professionals, and the society in general have a guide in pertinence to this theme. |
| Description: | Desde hace tiempos muy remotos se han venido regulando las formas a través de las cuales se puede dar por terminado el matrimonio, en ellas el divorcio ha venido siendo una figura muy importante.
El presente trabajo monográfico tiene por objeto el estudio, en términos generales, del divorcio y sus procedimientos, mismos que se encuentran regulados en nuestro ordenamiento jurídico vigente, en el cual se ha establecido un sistema preponderantemente oral para la sustanciación de los procesos en todas sus instancias, fases y diligencias, salvo los actos procesales que deban realizarse por escrito.
La presente investigación tiene por objetivo brindar a la sociedad un conocimiento sobre los actuales procedimientos vigentes para la terminación del matrimonio. Para ello se ha realizado un estudio del divorcio como una de las maneras de terminación del vínculo matrimonial, para determinar, en cada caso, cual es el camino a seguir para obtener el mismo, para ello se ha tenido en cuenta, las reformas realizadas al Código Civil, el Código Orgánico General de Procesos, doctrina, con el fin de dar una visión actualizada para que tanto estudiantes, profesionales y la sociedad en general tengan una guía respecto de este tema. |
