| Abstract: | The legislative function issued the Organic Law for Labor Justice and Recognition of work in the home, the normative body went on to reform, substitute and repeal certain articles of the Labor Code, and to introduce certain legal figures with the purpose of granting greater protection to the and workers, such as the declaration of ineffective dismissal of pregnant women or associated with their gestation or maternity status, trade union leaders and women in pregnancy as a priority attention group as protected by the Constitution of Ecuador,
The form of ineffective dismissal formally provides greater legal certainty to pregnant women, in many cases it becomes inoperable because of its short terms of processing, this body of legislation is not fulfilling the purpose with which it was issued, and the principle of procedural economy would only be in normative text, this figure is processed in summary way with the reduction of terms.
This is why the purpose of this graduation work is to analyze the figure of ineffective dismissal of pregnant women, for which we will analyze the normative bodies, jurisprudence and doctrine related to the subject, also demonstrate that the terms are inoperable in practice, which would have to be reformed by the legislator. |
| Description: | La función legislativa expidió la Ley Orgánica para la Justicia Laboral y Reconocimiento del trabajo en el hogar, el cuerpo normativo entro a reformar, sustituir y derogar ciertos artículos del Código de Trabajo, y a introducir ciertas figuras jurídicas con la finalidad de otorgar mayor protección a las y los trabajadores, como la declaratoria de despido ineficaz a las mujeres embarazadas o asociado a su condición de gestación o maternidad, a los dirigentes sindicales y las mujeres en estado de gravidez al ser un grupo de atención prioritaria tal como lo ampara Constitución de la República del Ecuador,
La figura del despido ineficaz formalmente otorga una mayor seguridad jurídica a las mujeres embarazadas, en muchos de sus casos se convierte en inoperable por sus cortos términos de tramitación, dicho cuerpo normativo no está cumpliendo con la finalidad con la que fue expedida, y el principio de economía procesal solo quedaría en texto normativo, dicha figura se tramita en vía sumaria con la reducción de términos.
Es por ello que el presente trabajo de graduación tiene como finalidad analizar la figura del despido ineficaz de la mujer embaraza, para lo cual se analizara los cuerpos normativos, jurisprudencia y doctrina relacionado al tema, además demostrar que los términos son inoperables en la práctica, lo cual tendría que ser materia de reforma por el legislador.
