Abstract

The purpose of the following research is to conduct a detailed and critical analysis of the Constitution and the American Convention on Human Rights in order to determine the influence this international instrument has in our legal system, with a special focus on protection rights, seeking to present the adequate means for an effective protection of this rights in accordance with what the Constitution establishes, the provisions of the Convention, and other international instruments which are transcendental to generate legal certainty and confidence in the judicial system, given that the State is obligated to provide citizens with adequate and effective means for the protection and respect of human and fundamental rights.
