Abstract: | It is important to establish the characteristics of rates and their relationship to the figure of public prices. The rates are one of the tributary sub-species that over time have generated an infinite doctrinal discussion about the nature of their taxable event especially because of their confusion or similarity with another form of (non-tax) financing known as public prices .
The tax, forms part of the tax categories, and forms part of the obligatory benefits that the State establishes, this by virtue of the faculty granted by the Constitution. The Organic Code of Territorial Organization Autonomy and Decentralization (COOTAD), in different articles, attributes the tax authority to the Decentralized Autonomous Governments, except rural parish, so that they can create, modify or suppress special taxes and contributions. Our legal regulations have not determined a definition of tribute, however, in the second paragraph of article 1, paragraph 2 of the Tax Code, states: "For these purposes, taxes, rates and special or improvement taxes are understood as taxes.
Public prices are those that emanate from the provision of services or carrying out activities within the regime of public law, it being important that these services or activities comply with these circumstances: That the service rendered or the activities carried out are performed Same way by the private sector. And that request of the service or activity is made voluntarily by the applicant. |
Description: | Es importante establecer las características de las tasas y su relación con la figura de los precios públicos.Las tasas son una de las sub-especies tributarias que a lo largo del tiempo han generado una infinita discusión doctrinal en torno a la naturaleza de su hecho imponible especialmente por su confusión o similitud con otra forma de financiamiento (no tributaria) conocida como precios públicos.
La tasa, forma parte de las categorías tributarias, y forma parte de las prestaciones obligatorias que el Estado establece, esto en virtud de la facultad otorgada por la Constitución. El Código Orgánico de Organización Territorial Autonomía y Descentralización (COOTAD), en diferentes artículos atribuye la facultad tributaria a los Gobiernos Autónomos Descentralizados, excepto a los parroquiales rurales, para que puedan crear, modificar o suprimir tasas y contribuciones especiales. Nuestra normativa jurídica no ha determinado una definición de tributo, sin embargo en el inciso segundo del artículo 1 inciso 2do del Código Tributario establece que: "Para estos efectos entiéndase por tributos los impuestos, las tasas y las contribuciones especiales o de mejora.
Sobre los precios públicos son aquellos que emanan de la prestación de servicios o realización de actividades dentro del régimen de derecho público, siendo importante que estos servicios o actividades cumplan estas circunstancias: Que el servicio que se preste o las actividades que se realicen sean realizadas de igual manera por el sector privado. Y que esa solicitud del servicio o actividad sea hecha de forma voluntaria por el solicitante. |
