Abstract

ABSTRACT In this paper the verification of legality of acts emanating from the public administration is analyzed, for which it is part of the generalities of Administrative Law and Administrative act, later to delve to the topic under study. The administrative act is the most common mode of action of the administration, hence its importance. The administrative act has in its favor the presumption of legitimacy and is enforceable, it must meet essential element to be such. However having in your favor those characters, the act may be subject to review by the administration itself, or be challenged by administrative or jurisdictional managed, in exercise of the right to defense that protects the Constitution. In addition, the administrative act may be subject to judicial review, to ensure the effectiveness of the principle of legality. The legality of the administrative action in our country is exercised: administrative, interposing administrative resources; in court proceedings through the filing of an action before the Court of Administrative or case before the Tax Dispute Court; and finally the Constitutional Control (which is not properly legality). Is part of legality verification of the legitimacy and opportunity in the issuance of administrative acts, no verification of these are reasons for extinction and reform it. Furthermore, it should oversee the administrative act, through a set of rules.
