Abstract

ABSTRACT This research, entitled "The legal check and regulation framework in Ecuador" refers to a deep analysis of the provisions of the Organic Monetary and Financial Code such as the General Regulations of the Checks Act repealed but still effective in this area. This research, addresses to the problems that arises when handling a Check, because in our society, the check has become a star at the moment of making payments. Without doubt, we can say that checks can easily replace currency while providing an easy way to do business and transactions. However, there is a lack of knowledge in our society in how to use a check. Therefore, most of the people prefer to continue using the same mechanism of payment, which is cash, rather than accepting a check. This has caused a drop in the mode of payment with checks, because people associate checks with fraud, which can lead to a loss in business. For this reason, it is necessary to do an analysis of the law that regulates all the issues that has to do when handling a check. So that, we can reach people by providing a greater understanding and knowledge about this mechanism of payment by showing them how to write a check, how to make a payment using a check, deadline of cashing a check, etc.
