Arbitraje comercial internacional: una perspectiva local

Abstract

The following investigation Project is focused in the Arbitration as an efficient alternative for the resolution of conflicts, especially those referred to the international commerce.

Therefore, it approaches the generalities, concept, characteristics and historic evolution of the arbitration, in order to provide a complete overview that allows the reader to understand the principal elements of the arbitration as an alternative method for the resolution of conflicts, especially about the arbitration agreement, which is one of the most important elements of the arbitration.

Afterwards, the investigation Project is focused in the International Commercial Arbitration, indicating at first, in which it consist, and which are the requirements to consider as International Commercial Arbitration; and finally, which are the advantages of that system compared to the ordinary system to resolve conflicts.

Subsequently, one entire chapter was dedicated to Comparative Law, due to its importance in the development of different juridical institutions, therefore the most important elements – which are referred to arbitration - were analyzed, in the following countries: Colombia, Chile, Spain and Germany. Finally, there is a descriptive analysis of several Arbitration entities worldwide.
