| Abstract: | It has been known that natural obligations have existed since the Roman law, and since that time, as regulated as an obligation that had no action against the debtor, a situation which has not changed to this day d today, as you can tell that natural obligations are those that do not give the creditor action to force the debtor to comply, but if the debtor fulfilled the obligation, give the right to retain the amount paid. Then we have a duty left to the discretion of the debtor, that is, the debtor may or may not fulfill the obligation, the creditor can not take any action towards the debtor.
Therefore this research work, discusses the natural obligations, their concept, their classes as discussed in this paper are natural obligations from the beginning, that is, who were born as such, but also try on civil obligations for one reason or another became natural, this in order to understand fully the natural obligations; also we analyze the legal effects, as already mentioned one of its effects is to retain the right to the amount paid by the debtor, and other effects that develop over the course of this work; his differences with the civil law; finally this work is to study the natural obligations in full. |
| Description: | Se ha conocido que las obligaciones naturales han existido desde el derecho romano, ya desde esta época, lo regulaban como una obligación que no tenía acción alguna en contra del deudor, situación que no ha cambiado hasta el día d hoy, ya que se puede decir que las obligaciones naturales son aquellas que no dan acción al acreedor para poder obligar al deudor a cumplirlas, pero si el deudor cumpliese la obligación, le dan el derecho de poder retener lo pagado. Entonces estamos ante una obligación que queda al libre arbitrio del deudor, es decir, el deudor puede o no cumplir la obligación, ya que el acreedor no puede ejercer ninguna acción para con el deudor.
Por lo cual el presente trabajo investigativo, trata sobre las obligaciones naturales, su concepto, sus clases que como veremos en este trabajo, son, obligaciones naturales desde su origen, es decir, que nacieron como tales, pero también trataremos sobre las obligaciones civiles que por una u otra causa se convirtieron en naturales, esto con el fin de entender a cabalidad las obligaciones naturales; también analizaremos sus efectos jurídicos, como ya lo mencionamos uno de sus efectos es el derecho de poder retener lo pagado por el deudor, y otros efectos que desarrollaremos en el transcurso de este trabajo; sus diferencias con el derecho civil; en fin este trabajo trata de estudiar las obligaciones naturales en su totalidad. |
