| Abstract: | This paper seeks to understand how when and why? They were created and the rights of children and adolescents , in addition to analyzing the development of the same , that through a historical analysis of the society and States from ancient times until our days , where we already have a wide range of rights , security , institutions and policies to their benefit
For a better understanding, in the first chapter I considered necessary historical background and evolution of the rights of children and adolescents and historical events that inspired the need for laws to their advantage
Later in the second chapter, we see the historical background, in Ecuador from a doctrinal perspective, I mean the passage of the Doctrine of Irregular of the Doctrine of Integral Protection Situation and legislative changes that occurred after the adoption of the latter doctrine in addition to the regulatory and institutional changes inspired by the life of the 2008 Constitution.
Finally in the third chapter find all the principles underlying the Code for Children and Adolescents also mediated protection of both the Code and the Constitution with regard to finally see what the Cantonal Board and its functions. |
| Description: | El presente trabajo busca conocer ¿cómo cuándo y por qué? se crearon y de los Derechos de los niños, niñas y adolescentes, además de analizar el desarrollo de los mismos, esto a través de un análisis histórico de la sociedad y los Estados desde la edad antigua, hasta nuestro días, donde cuentan ya con una amplia gama de derechos, garantía, instituciones y políticas a su favor.
Para una mejor comprensión, dentro del primer capítulo he considerado necesario los antecedentes históricos y la evolución de los derechos de la niñez y adolescencia y los acontecimientos históricos que inspiraron la necesidad de establecer leyes a su favor.
Posteriormente en el segundo capítulo, veremos los antecedentes histórico, en el Ecuador desde una perspectiva doctrinaria, es decir del paso de la Doctrina de Situación Irregular a la Doctrina de Protección Integral, y los cambios legislativos que se dieron después de la adopción de esta última doctrina además de los cambios normativo e institucionales inspirados por la vigencia Constitución del 2008.
Para finalizar dentro del tercer capítulo encontraremos todos los principios que inspiran al Código dela Niñez y Adolescencia, además de las medidas de protección tanto del Código como de la Constitución y finalmente veremos lo referente a lo que es la Junta Cantonal y sus funciones. |
