| Abstract: | The following essay focuses interest on an overview about Objective Duty of Care, Guilt as an element of guiltiness, historical background, evolution and development of Criminal Science and the various ways in which they may arise.
The dynamic development and progress of society, fated and immersed into unavoidable scientific and technological advances, promoters in all kinds of social living, requiring permanent change and updating, to which the law, legal system and other laws that regulate certain situations and actions of social life, can be found apart. In this context a regulatory framework, the duty of care, the defense of justice, legal systems, the trust given by the people so that their legal rights are not violated, including the self-responsability of the victim and the permitted risk, whose generating responsibility of any law, regulation or rule as we know, restsin the legislature and administration in the different instances of the judicial power.
But as we are all obligated to contribute, there has been the reason to raise contribution to the Ecuadorian Criminal Justice System; create and adapt offenses that sanction actions, or omissions that harm protected rights with appropriate sanctions, if they produce and put them in danger; aware that in a society without laws, a person without contributions are sterile entities and are unrelated to the imperative future. |
| Description: | La presente monografía centra interés en una visión general a cerca del Deber Objetivo Cuidado, la Culpa como elemento de la Culpabilidad, antecedentes históricos, evolución y desarrollo en la Ciencia Penal y sus diversas formas en las que puede presentarse.
El dinámico desarrollo y progreso de la sociedad, avocada e inmersa a ineludibles avances científico-tecnológicos, impulsores de cambios en todo orden del convivir social, exige mantenernos en permanentes transformaciones y actualización, de la que el derecho, los sistemas legales y más leyes que regulan determinadas situaciones y acciones de la vida social, pueden hallarse al margen. En este contexto, toda normativa, el deber de cuidado, la defensa de la justicia, sistemas legales, la confianza otorgada por las personas para que sus bienes jurídicos no se lesionen, incluyendo la autorresponsabilidad de la víctima y el riesgo permitido, cuya responsabilidad generatriz de toda ley, reglamento o norma, como bien sabemos, descansa en el poder legislativo y su administración en las distintas instancias del poder judicial.
Pero bien si todos estamos obligados a contribuir, ha sido la razón para plantear algún aporte al Sistema Penal Ecuatoriano; crear y adecuar tipos penales que sancionen acciones u omisiones que lesionan bienes jurídicos protegidos, con sanciones adecuadas, si estos se producen y ponen en peligro los mismos; consciente de que una sociedad sin leyes, una persona sin aportes, son entes estériles y ajenos al imperativo futuro. |
