Abstract: | This research work, starts from the fact the contentious administrative proceeding is the trial that poses a managed before the competent court, on pretentions based on administrative law rules where one of the parts is the State; for acts considered illegal and prejudicial to their rights. The performance of State institutions are presumed legitimate, because they target the common good, but there are cases in which the managed have resorted to litigation appeals to alleged abuses or excesses of power of such organizations, seeking the annulment of the contested acts for violating their interests. In this process and in the series of events that progressively unfold to culminate in a judicial decision, it must demonstrate the effective exercise of the right to due process and basic guarantees, observing the application of both the following principles: contradiction, advertising, legality, speed, immediacy, procedural fairness, etc. Being a relatively new subject, administrative matter, and even more, possessing in our legal system a guarantor Constitution, the exercise of constitutional rights requires proper guidance; as in the conduct thereof and having interest the State and the managed, can even be considered that principles and constitutional rights are violated or hierarchically diminished, for thatit has to be monitored the development of the initial, probation and resolution stages, which must be founded on the basis of rights of litigants, and under that great institution that is the due process. |
Description: | El presente trabajo investigativo, parte de que el proceso contencioso administrativo es el juicio que plantea un administrado ante el tribunal competente, sobre pretensiones fundadas en normas de derecho administrativo en donde una de las partes procesales es el Estado; por actos considerados ilegales y que lesionan sus derechos. La actuación de instituciones Estatales se presumen legítimas, porque tienen como meta el bien común, pero existen casos en los cuales los administrados han recurrido a los recursos contenciosos ante presuntos abusos o excesos de poder de los mencionados organismos, buscando la anulación de los actos impugnados por vulnerar sus intereses. En este proceso y en la serie de actos que se desenvuelven progresivamente para culminar en una decisión judicial, se debe evidenciar el efectivo ejercicio del derecho al debido proceso y sus garantías básicas, observando la aplicación, tanto de los principios de: contradicción, publicidad, legalidad, celeridad, inmediación, lealtad procesal, etc. Al ser la materia administrativa, una materia relativamente nueva, y aún más, al poseer dentro de nuestro ordenamiento jurídico una Constitución garantista, el ejercicio de los derechos constitucionales requiere de una correcta guía, pues en el desarrollo de la misma y por intereses que presenta el Estado y el administrado, puede llegar a considerarse que principios y derechos constitucionales son violentados o jerárquicamente disminuidos, para ello se fiscaliza el desarrollo de la etapa inicial, probatoria y resolutoria, que deben fundarse en base a derechos de las partes procesales, y en virtud de esa gran institución que es el debido proceso. |
