| Abstract: | The judicial error can be found in full force in our Legal System, by following the guideline of a system of objective responsibility that the Federal State has with its administrator. This Legal Institution of remarkable transcendence and grandeur has the premise idea that nobody can achieve perfection; that means that all individuals are prone to commit mistakes. The same statement cannot be said of the Judges that in their noble, but complex role find themselves daily in the border line that separates what is just from what is unjust, and in many circumstances, what legal from what is not.
The idea of judicial error arise from by the development of this notion, which is not other than the constant inaccurate failure in a providence, dictated by an jurisdictional system, mistake that transforms it into unjust and inaccurate; in full disagreement of the active judicial system that causes a tremendous damage and might be originated by the sole responsibility of the Federal State. However, not every error is originated by the federal State Responsibility so there are certain aspects, as well as strict liabilities that limit this institution.
Under these postulates the need arises to fully upright capable and knowledgeable judges who know the causes under the most weighted criteria of justice and impartiality, and act within strict accordance to the existing law but above all to the Constitution and Human Rights. |
| Description: | El error judicial se encuentra con plena vigencia en nuestro sistema jurídico, siguiendo el lineamiento de un sistema de responsabilidad objetiva que tiene el Estado para con sus administrados. Esta institución jurídica de notable trascendencia tiene como premisa la idea de que nadie puede alcanzar la perfección, lo que es decir que todos somos propensos a errar, no se puede decir lo contrario de los Señores Jueces que en su noble pero compleja función se encuentran día a día en el lindero que separa lo justo de lo injusto y en muchas ocasiones lo legal de lo ilegal.
Por esta idea surge la noción del error judicial, que no es otra cosa que el desacierto o falencia constante en una providencia, dictada por un órgano jurisdiccional, yerro que la convierte en injusta o desacertada, en pleno desapego del ordenamiento jurídico vigente, que causa un daño y que ha de ser originadora de la responsabilidad del Estado. Sin embargo no todo error es originador de responsabilidad estatal por lo que existen ciertos aspectos, así como eximentes de responsabilidad que limitan a esta institución.
Bajo estos postulados surge la necesidad de Jueces totalmente probos y estudiosos que conozcan de las causas bajo los más ponderados criterios de justicia e imparcialidad, que obren en estricta observancia al ordenamiento jurídico vigente pero por sobre todo a la Carta Magna y los Derechos Humanos. |
