El principal objetivo de este trabajo es definir aquellas pautas que la Corte Constitucional Ecuatoriana utiliza para poder alejarse del precedente constitucional. Para cumplir aquel objetivo se ha definido empezar por la base de esta figura, siendo el precedente tanto a nivel general como dentro del contexto ecuatoriano, para posteriormente analizar a la figura del overruling, y su incidencia en el Ecuador. En base a ello, se ha optado por tomar dentro del estudio pautas que se generan en el derecho comparado, en la propia Ley Orgánica de Garantías Jurisdiccionales, en base al estudio de diversos doctrinarios, y pautas que la propia Corte Constitucional a lo largo de diversas sentencias ha definido, para poder llegar a un solo acuerdo sobre estas y recomendar en el ejercicio del alejamiento, el establecimiento de determinadas pautas.The following study constitutes a theoretical-bibliographical, constitutional, and legal analysis work on the method of departure from precedent, overruling, in the Ecuadorian context. The main objective of this work is to define the guidelines that the Constitutional Court uses to overrule. To overcome this objective, it is necessary to define the basis of this figure, being the precedent, in a general context and the Ecuadorian context, to later analyze overruling and its incidence in Ecuador.
