| dc.description | El trabajo de investigación que se presenta a continuación, contiene un estudio acerca de la normativa penal que regulan conductas misóginas del varón en contra de la mujer, el femicidio. Este ilícito se encuentra tipificada en el artículo 141 del Código Orgánico Integral Penal, por ello, se expone el estudio desde sus orígenes de cómo nació, evolucionó y las diversas formas de tratamiento de este crimen en Latinoamérica. Además, en el estudio se investiga si en esta norma penal del Ecuador es objeto de interpretaciones ambiguas que repercuten en condenas injustas. De esta manera, se analiza un caso de femicidio de impacto social en el país, en el que se observan circunstancias que ensombrecen aún más el injusto penal de femicidio; de tal forma que se verificarán los problemas que ocasiona este cuerpo legal. Finalmente, se realizarán una entrevista a un tribunal penal del Ecuador, para que emitan su criterio formal de la norma penal y del caso propuesto. Asimismo, luego del proceso investigativo planteado, se puede emitir las conclusiones que satisfagan a esta investigación. | es_ES |
| dc.description.abstract | The research work presented below contains a study about the criminal norms that regulate the misogynistic behavior of men against women, femicide. This article is typified in article 141 of the Integral Penal Organic Code, therefore, it is exposed in the study of its origins of how it was born, evolved and the different forms of treatment of this crime in Latin America. In addition, the study investigates whether in this criminal norm of Ecuador it is a question of ambiguous interpretations that affect unjust conditions. In this way, a case of femicide of social impact in the country is analyzed, in which the circumstances that further obscure the unjust criminal of femicide are observed; in such a way that the problems caused by this legal body will be seen. Finally, there will be an interview with a criminal court in Ecuador, to issue its formal criteria. Also, the investigative process proposed, the conclusions that satisfy this investigation can be issued. | es_ES |
