    Eficacia de la boleta de auxilio como medida de protección en casos de violencia intrafamiliar en Cuenca (2024-2025)

    Domestic violence and gender-based violence are structural and social problems that affect a wide range of civilizations and populations, as is the case in Cuenca, Ecuador. To address this issue, the State has provided victims of violence with various mechanisms for their protection. It has likewise implemented policies aimed at their empowerment and comprehensive development, promoting their active participation in society. Among these mechanisms are protection measures, as established in Article 558, paragraph four, of the Comprehensive Organic Criminal Code, specifically regarding the issuance of emergency protection orders in cases of violence against women or members of the family nucleus. This research analyzes the effectiveness of protection orders in cases of intrafamily violence in Cuenca, considering that, although they constitute an urgent legal mechanism intended to prevent the continuation of violent acts, their practical effectiveness is questionable. The study employs a qualitative approach, involving doctrinal and normative analysis of the legal system, as well as a quantitative approach that examines statistical data. The methodology used included documentary and legal review, data analysis, and interviews with public officials responsible for issuing these administrative protection measures. The findings reveal the ineffectiveness of protection orders due to multiple factors associated with institutional multi-competence at the time of issuance, including the lack of coordination and uniform protocols, which generate deficiencies in the justice system, procedural overload for judges, and a negative impact on the real and effective protection of victims.
