| Abstract: | Workplace harassment is a growing global problem that threatens the dignity and
integrity of people and has negative consequences on the quality of life of the worker. In
harmony with international regulations, the Ecuadorian state has implemented public policies
and has incorporated affirmative action measures in its internal legislation to guarantee the
effective enjoyment of the rights to protect the worker from workplace harassment.
In this research, the legislations that have autonomously defined the figure of
workplace harassment are reviewed and the differences around its classification and burden
of proof and its reversal are established; with main emphasis on the Ecuadorian labor system.
A documentary bibliographic review was carried out, in which the historical-logical,
comparative and inductive-deductive methods were applied simultaneously, focused on
determining the scope and protection of the rights of those who are immersed in a
relationship. work, and the conflicts of legitimacy and legality of the test at the time of
resolving and configuring workplace harassment in the Ecuadorian legal framework. |
| Description: | El acoso laboral es un problema mundial creciente que atenta contra la dignidad e
integridad de las personas y que produce consecuencias negativas en la calidad de vida del
trabajador. En armonía con la normativa internacional, el Estado Ecuatoriano ha
implementado políticas públicas y ha incorporado medidas de acción afirmativa en su
legislación interna para garantizar el efectivo goce de los derechos del trabajador y protegerlo
del acoso laboral.
En esta investigación, se revisan las legislaciones que han configurado de manera
autónoma la institución del acoso laboral y se establecen las diferencias en torno a su
regulación, carga de la prueba e inversión; con principal énfasis en el sistema laboral
ecuatoriano. Se realizó una investigación de tipo documental, de revisión bibliográfica, en la
que de manera simultánea se aplicaron los métodos histórico-lógico, comparado e inductivo
– deductivo, enfocados en determinar el alcance y protección de los derechos de quienes se
hallan inmersos en una relación laboral, y los conflictos de legitimidad y legalidad de la
prueba al momento de resolver y configurar el acoso laboral en el marco jurídico ecuatoriano. |
