Abstract: | The present analysis aims to identify within the Ecuadorian legal system the
axiom, "Non reformatio in peius" as a constitutional principle that protects the person
prosecuted at the time of appealing the judicial decision. In addition, identify its
relationship with other constitutional principles inherent to the criminal process. The
objective of this is to ensure that the rights of the accused are respected throughout the
entire process, so that their legal situation does not deteriorate as a result of having
requested a review of their conviction.
For this reason, this research analyzes the development made by the Código
Orgánico Integral Penal and the Constitution; and its contradiction since the criminal
norm limits the exercise of this constitutional guarantee. It is to be effective only when
the appellant is the prosecuted person, thus affecting the future by having the possibility
that another appeal process will worsen their legal situation. |
Description: | El presente análisis tiene como objetivo identificar dentro del ordenamiento
jurídico ecuatoriano al axioma “Non reformatio in peius” como principio constitucional
que protege a la persona procesada al momento de recurrir la decisión judicial. Además,
identificar su relación con otros principios constitucionales inherentes al proceso penal;
los cuales tienen como objetivo velar por el respeto de los derechos de la persona acusada
a lo largo de todo el proceso para que su situación jurídica no se vea empeorada como
consecuencia de haber pedido una revisión a su sentencia condenatoria.
Por ello, esta investigación analiza el desarrollo que hace el Código Orgánico
Integral Penal y la Constitución; y su contradicción ya que la norma penal limita el
ejercicio de esta garantía constitucional, a que sea eficaz solamente cuando el recurrente
es la persona procesada, afectando así el futuro al tener la posibilidad que se vea
empeorada su situación jurídica si es que además recurre otra parte procesal. |
