| Abstract: | During the development of the job, an analysis of all of the circumstances in fact and
in law that was related to the judicial process number 01283-2018-01476 was carried out,
whereby Hernan Patricio Coraizaca was killed and Jennifer Tatiana Guzhñay was processed
for being presumed to be responsible for the assassination tipified in the Article 140, number
1 of the Organic Integral Criminal Code (COIP).
Within the investigation, there was a description of the actions of each of the organisms
who intervened and resolved the issue. The circumstances were also established within the
people who committed the judged infractions, and the evidence that was valued within the
process. In addition, a detailed study was carried out of the sentence emitted by the Court of
Guaranteed Criminals on site in Cuenca, where the case is sustained, that ratified the innocent
status of Jennifer Tatiana Guzhñay for having acted with legitimate defence. Similarly, each of
the arguments sustained by the Fiscal General of the state, the technical defense of the victim
and of the accused, was analyzed. Whereby the study was carried out rigorously and with detail
of the legitimate defence of each of the necessary and indispensable requirements in order to
plead, but from a focus of the intrafamilial violence that merits the present case |
| Description: | Durante el desarrollo del trabajo se realizó un análisis de todas las circunstancias de
hecho y de derecho que tuvo relación al proceso judicial número 01283-2018-01476, en el cual
se dio muerte a Hernán Patricio Coraizaca Guamán y se procesó a su pareja Jennifer Tatiana
Guzhñay Chacha, por presumirle ser responsable del delito de asesinato tipificado en el Art.
140 numeral 1 del Código Orgánico Integral Penal (COIP).
Dentro de la investigación se describió las acciones de cada uno de los organismos que
intervinieron y resolvieron el tema. También se estableció las circunstancias dentro de las
cuales se cometieron las infracciones juzgadas, y las pruebas que fueron valoradas dentro del
proceso. Además, se realizó un estudio pormenorizado de la sentencia emitida por el Tribunal
de Garantías Penales con sede en Cuenca, que sustancio la causa, tribunal que ratificó el estado
de inocencia de Jennifer Tatiana Guzhñay por haber actuado en legítima defensa. De igual
manera se analizó cada uno de los argumentos que sostuvo Fiscalía General del Estado, la
defensa técnica de la víctima y de la procesada. Por lo cual se realizó el estudio riguroso y
detallado de la legítima defensa como de cada uno de los requisitos indispensables y necesarios
para que pueda alegarse, pero desde un enfoque de la violencia intrafamiliar que amerita el
presente caso |
