Abstract: | The present work develops the subject of the voluntary jurisdiction in the Ecuadorian legislation. To do this, first of all, we distinguish between voluntary and contentious jurisdiction, determining the characteristics of each. In this sense, it is determined that the fundamental difference that exists between them is the existence of a conflict, understood as the opposition of interests between the parties. Therefore, the processes of voluntary jurisdiction are not intended to resolve a conflict between the parties, nor to administer justice. Therefore it is not considered as properly jurisdictional, since its purpose is to recognize an act that does not imply a grant of rights, which has been raised voluntarily by the parties.
It then analyzes the processes of voluntary jurisdiction with exclusive jurisdiction of both the notary and the judge, established in article 18 of the Notary Law and article 344 of the COGEP, respectively. In the first case, in relation to the first 28 numerals, a brief comment has been made in relation to notarial competition, and has dealt, separately, the new notarial powers that, since the entry into force of the COGEP have Been added to Article 18.
All these considerations have been contrasted in the analysis of comparative law and the study of jurisprudence. Based on this work, competencies have been determined that should have been attributed to notaries, because they fulfill the purpose of the reform, which is to reduce the procedural burden of judges. |
Description: | El presente trabajo desarrolla el tema de la jurisdicción voluntaria en la legislación ecuatoriana. Para ello, en primer lugar, se distingue entre jurisdicción voluntaria y contenciosa, determinando las características de cada una. En este sentido, se determina que la diferencia fundamental que existe entre ellas es la existencia de un conflicto, entendido como la oposición de intereses entre las partes. Por lo tanto, los procesos de jurisdicción voluntaria no tienen como finalidad dirimir un conflicto entre las partes, ni administrar justicia. Por ello no es considerado como propiamente jurisdiccional, ya que su finalidad es reconocer un acto que no implica un otorgamiento de derechos, que ha sido planteado de manera voluntaria por las partes.
Luego se analiza los procesos de jurisdicción voluntaria de competencia exclusiva tanto del notario como del juez, establecidos en el artículo 18 de la Ley Notarial y el artículo 344 del COGEP, respectivamente. En el primer caso, en relación a los 28 primeros numerales se ha realizado un breve comentario en relación a la competencia notarial, y se ha tratado, de forma separada, a las nuevas competencias notariales que a partir de la entrada en vigencia del COGEP han sido añadidas al artículo 18.
Todas estas consideraciones ha sido contrastadas en el al análisis del derecho comparado y el estudio de la jurisprudencia. En base a este trabajo se han determinado competencias que debieron atribuirse a los notarios, en razón de cumplir con la finalidad de la reforma, que es la disminución de la carga procesal de los jueces. |
