| Abstract: | This research contains a study about the Fundamental Right of the Due Process of Law, and in itself, a study about the Right to Defense stated in the Constitution of the Republic of Ecuador, a right which we find present throughout time. The most remote written evidence of this right is found in the Magna Carta of Juan sin Tierra, a document issued in 1215. Since then, it has been incorporated in several sets of law of States, transferring the guarantees from the Due Process to the Universal Declaration of Human Rights of 1948 and the Pact of San José de Costa Rica.
The Due Process of Law is a Fundamental Right which encompasses a series of guarantees that must be respected in every process in which rights and duties of people are determined. It grants the Right to Defense, a sort of pre-eminence within such guarantees. It is the second time that the Constitution takes the guarantees of the Due Process to a constitutional law level and simultaneously widens its application field, the same which was restricted to penal field.
The aim of the project is to do a brief analysis of each one of the guarantees of the Due Process and specifically the Right to Defense in Civil Procedures stated in the current Constitution, said analysis will be reinforced by the contributions of doctrinarians, treatise writers and jurists related to the subject matter. Throughout this research, we envisage that the differences between the guarantees of the Due Process in the current Constitution and the one from 1998, have been quite significant, which implies a great development of such regulations. In addition, we must take into account that the Due Process is linked to basic constitutional regulations aiming to fairness, this means, that the constituted public powers have to adhere their acts (sentences, administrative procedures) not only to constitutional laws but also to values and principles. The main purpose is to guarantee an unbiased, fair, process in which the Rights owed to every person are observed, granted and applied correctly in order to get a clearer and more precise idea about the Due process itself, the Right to Defense and at the same time an appropriate content and lineament of each one of the guarantees stated in our current Constitution. |
| Description: | La presente investigación comprende un estudio acerca del Derecho Fundamental al Debido Proceso, y en sí, del Derecho a la Defensa establecidos en la Constitución de la República del Ecuador, derecho que lo encontramos presente a través del tiempo, la constancia escrita más remota acerca de este derecho se halla en la Carta Magna de Juan sin Tierra, documento expedido en 1215, desde ahí se fue incorporando en los distintos cuerpos normativos de los Estados, trasladándose tales las garantías del Debido Proceso a la Declaración Universal de los Derechos Humanos de 1948 y al Pacto de San José de Costa Rica.
El Debido Proceso es un Derecho Fundamental que a su vez engloba una serie de garantías, que deben respetarse en todo proceso en el que se determinen derechos y obligaciones de las personas; y otorgándole al Derecho a la Defensa, una especie de preminencia dentro de tales garantías. Es la segunda vez, que la Constitución eleva las garantías del Debido Proceso a rango de norma constitucional y que asimismo amplía su campo de acción, antes restringido únicamente al ámbito penal.
El proyecto tiene como finalidad realizar un breve análisis de cada una de las garantías del Debido Proceso y concretamente del Derecho a la Defensa en los Procesos Civiles establecidas en la actual Constitución, estudio que se verá fortalecido por los aportes doctrinarios, de tratadistas y jurisconsultos relativos al tema de estudio. Así como también, en el desarrollo del presente trabajo, vislumbramos que las diferencias entre las garantías del Debido Proceso en la Constitución vigente con la de 1998, han sido bastante significativas lo cual implica un gran desarrollo de tal normativa. Además, también debemos tener en cuenta que, el Debido Proceso está vinculado a normas básicas constitucionales tendientes al orden justo; esto supone, que los poderes públicos constituidos tiene que sujetar sus actos (sentencias, actos administrativos) no solamente a las normas constitucionales sino a los valores, principios y normas. Todo esto, con el único propósito de garantizar un proceso ecuánime, justo, en el que, los Derechos garantizados a todas las personas sean correctamente observados, garantizados y aplicados. De tal manera, con el resultado de esta investigación se conseguirá tener una idea más clara y precisa sobre el Debido Proceso y en sí, del Derecho a la Defensa e igualmente un contenido y lineamiento apropiado de cada una de sus garantías establecidas en la nuestra Constitución. |
