| dc.description | El presente trabajo brinda un análisis respecto del derecho a la acción ciudadana, mismo que al tener una redacción abierta e incluso ambigua, ha sido objeto de una nula reflexión por parte de la doctrina constitucional ecuatoriana. Al respecto se brinda un examen que parte del reconocimiento de este derecho como parte del ejercicio de la democracia participativa, y de la ciudadanía activa, mismos que articularon el proceso constituyente 2007-2008. Este trabajo precisamente pone de relieve las características específicas del derecho a la acción ciudadana, que si bien puede compartir muchos aspectos en común con ciertas figuras jurídicas similares del derecho comparado (especialmente con la «acción popular» colombiana) reviste una matriz teórica propia y un cariz jurídico fruto de las características del mencionado proceso legislativo, lo que desde nuestra perspectiva hace necesario la promulgación de una ley que regule y clarifique ciertos aspectos del derecho a fin de posibilitar su ejercicio. | en_US |
| dc.description.abstract | The present work offers an analysis regarding the right to citizen action, even though having an open and even ambiguous wording, it has been the object of null reflection by the Ecuadorian constitutional doctrine. In this regard, an examination is provided that starts from the recognition of this right as part of the exercise of participatory democracy, and active citizenship, which articulated the constituent process 2007-2008. This work precisely highlights the specific characteristics of the right to citizen action, which, although it may share many aspects in common with certain similar legal figures of comparative law (especially with Colombian "popular action"), has its own theoretical matrix and a legal aspect resulting from the characteristics of the aforementioned legislative process, which from our perspective makes necessary the promulgation of a law that regulates and clarifies certain aspects of the right in order to enable its exercise. | en_US |
