Responsabilidad Extracontractual del Estado frente a la crisis carcelaria en los Centros de Rehabilitación Social en el periodo comprendido entre febrero de 2021 hasta noviembre de 2022

Abstract

The purpose of this research work is to identify the concepts of public services, non-contractual liability of the State within the framework of the Social Rehabilitation System, with the purpose of defining whether on the part of the Ecuadorian State in the face of the prison crisis that is experienced in the Centers of Social Rehabilitation there is non-contractual responsibility for the deficiency or failure to provide public service within the CRS. Therefore, the qualitative methodology was applied, with a phenomenological approach, since it is intended to study the social phenomenon present within the Centers of Deprivation of Liberty in Ecuador, the legalexploratory technique was used, using as a tool the collection of bibliographic information, in turn

a dogmatic approach through which different notions such as public services, non- contractual liability and Penitentiary System will be conceptualized. As a result, it was possible to verify that the Administration within the Social Rehabilitation Centers is classified as a public service, which is why if we are talking about a lack or deficient provision of public service, which as a consequence generates damage that the administered is not forced to bear the ecuadorian State is responsible.
