El delito de Child Grooming en el Código Orgánico Integral Penal

Abstract

The facilities that new technologies offer us have given way to arbitrary use by those who occupy social networks to contact anyone anywhere in the world, having as vulnerable entities children and adolescents who have access to the Internet without supervision of any adult, being exposed to cyber sexual harassment from people who use the network for these purposes. Given this, Ecuador saw itself in the duty to legitimize regulations aimed at protecting the psychological and sexual integrity of these subjects of rights, incorporating into the Comprehensive Organic Criminal Code in its art. 173, a sanction for anyone who maintains "contact for sexual purposes with minors under eighteen years of age by electronic means", known worldwide as the crime of Child Grooming, That is why this research project is aimed at carrying out an analysis, addressing the problem of child grooming in its general aspects as well as in the background for its typification, with which it could be evidenced that the article in question contains certain problems that they fail to adequately satisfy the prevention, sanction and proportionality of the penalty at the time of judging whoever falls into this type of crime, and therefore should be subject to observation to improve said situation.
