dc.description | En Ecuador, la acusación particular está estipulada en el Código Orgánico Integral Penal (COIP) y comprende la expresión de voluntad del ofendido de volverse parte primordial del proceso penal y su capacidad de intervenir activamente en distintas etapas. Precisamente, esta investigación presenta la importancia en el sistema procesal penal acusatorio de la acusación particular; la acusación es la acción y efecto de atribuir un delito, por ende, la acusación particular hace referencia a que la víctima, personas que individual o colectivamente hayan sufrido daños como consecuencia de acciones que violen la legislación penal vigente (ONU,1985), acusa a otro individuo de un delito. El sistema procesal penal acusatorio se desarrolla de forma oral y así la víctima puede ser escuchada por el Juez. La importancia de la acusación particular recae en la reparación eficaz de la víctima, el respeto a los derechos humanos, tanto de la víctima como del acusado, y el cumplimiento de los principios de igualdad. El análisis del COIP, distintos documentos legislativos e internacionales sobre Derechos Humanos y un análisis de caso, dará a conocer la relevancia de la acusación particular dentro del ordenamiento jurídico y el sistema procesal penal acusatorio; es una oportunidad para la víctima de ser escuchada y prevalecer dentro del proceso penal, lo cual representa un avance jurídico para el país. | en_US |
dc.description.abstract | In Ecuador, the private accusation is stipulated in the Comprehensive Organic Criminal Code (COIP) and includes the expression of will of the offended party to become a primary part of the criminal process and its ability to actively intervene in different stages. Precisely, this research presents the importance in the accusatory criminal procedural system of the private accusation; the accusation is the action and effect of attributing a crime, therefore, the private accusation refers to the victim, people who individually or collectively have suffered damages because of actions that violate the current criminal law (UN, 1985), accuses another individual of a crime. The accusatory criminal procedural system is developed orally and thus the victim can be heard by the judge. The importance of the private accusation lies in the effective reparation of the victim, respect for the human rights of both the victim and the accused, and compliance with the principles of equality. The analysis of the COIP, different legislative and international documents on Human Rights and a case analysis, will show the relevance of the private accusation within the legal system and the accusatory criminal procedure system; it is an opportunity for the victim to be heard and prevail within the criminal process, which represents a legal advance for the country. | en_US |
