| dc.description | El Código de Comercio promulgado en el año 2019 aporta una significativa y nueva figura en la legislación ecuatoriana: “La Prestación Irrisoria”. Esta consiste en la posibilidad de evitar un perjuicio en las prestaciones de un contrato conmutativo por falta de equivalencia, sin embargo, el problema que se presenta con esta nueva figura es la incompatibilidad de los efectos que produce un contrato no conmutativo, debido a que permite declarar la nulidad absoluta del contrato, cuando por años se ha venido aplicando de acuerdo al Código Civil la Nulidad Relativa. Un análisis comparativo y crítico permitirá destacar las falencias que se pueden presentar al momento de aplicar las disposiciones de la Prestación Irrisoria para identificar cuando aplica la rescisión y cuando la resolución del contrato para posteriormente buscar una solución que permita aplicar correctamente el artículo 217 del Código de Comercio. Más aún el Código de Comercio a pesar de sus falencias sobre la Prestación Irrisoria permite un alcance que también debería permitirse en el Código Civil que es la posibilidad de rescindir un contrato por lesión enorme de contratos sobre bienes muebles, así como la posibilidad de la Corrección de Intereses por parte del juzgador | en_US |
| dc.description.abstract | The comercial code issued in the year 2019 has contributed a significant and new figure in the Ecuadorian legislation: the derisory perfomance. This consists in the possibility of avoiding loss of benefits of commutative contract for lacking of equivalence; nevertheless, the problem that presents with this new figure is the incompatibility of effects that produces a non-commutative contract, well it does not allow the highlights of the short coming of the time of applying the provisions of the derisory perfomance to identify when the rescission applies and when the resolution of the contract subsequently finds a solution that allows the correct application of Article 217 of the commercial code.
