dc.description | El procedimiento abreviado regulado en Ecuador a partir del artículo 635 del Código Orgánico Integral Penal, tiene como característica la negociación de una pena, elimina el juicio normal, de aquello surge la necesidad de entender si éste permite al juzgador garantizar el cumplimiento de los principios del debido proceso. Estudiaremos los orígenes del procedimiento abreviado, su adopción en nuestra legislación, si su regulación permite al juzgador tutelar la vigencia de principios como: motivación, debido proceso, prohibición de autoincriminación, al suprimir etapas de un proceso normal, dictarse una sentencia condenatoria, admisión de hechos en relación a la forma de desvirtuar la presunción de inocencia. La metodología fue el enfoque cualitativo, análisis bibliográfico, entrevistas a jueces, fiscales, defensores del cantón Cuenca, sobre este procedimiento y análisis de casos para determinar que parámetros justifican una sentencia condenatoria, los resultados muestran que la regulación limita al juzgador, no le permite llegar a tener convicción más allá de toda duda razonable, no analiza elemento alguno, se limita a aceptar una pena negociada y se atenta contra el principio de motivación, prohibición de autoincriminación. Se sugiere, una opción es que se tramite después de existir auto de llamamiento a juicio donde los elementos son prueba legal y constitucional, servirán al juzgador para análisis y no sea la confesión o admisión la base de una sentencia, un estudio sobre la relación de la reincidencia y este procedimiento | en_US |
dc.description.abstract | The abbreviate procedure regulated in Ecuador from article 635 of the criminal code, has a characteristic the negotiation of a penalty eliminates the normal trial from which arises the need to understand if it allows the judge to guarantee the principles of a due process. We will study the origins of the abbreviate procedure its adaptation in our legislation, its regulation allows a judge to protect principles such as: Motivation, due process, prohibition of self-incrimination, elimination stages of a normal process, issuing a conviction, the admission in relation to how to disprove the presumption innocence. The methodology was qualitative approach, bibliographic analysis, interviews with judges, district attorneys, public defensor of Cuenca, about this procedure and the analysis of cases show that the law limit the judge, it doesn’t allow him to have a conviction beyond all reasonable doubt, the judge doesn’t analyze any element, he only accepts a penalty that has been negotiated and them goes against of principle motivation, prohibition of selfincrimination. It is suggested that it should be applied after there is an order to initiate a trial where the elements are legal evidence and constitutional, they will serve the judge for the analysis and that way the confession won’t be the basis of a veridical or judicial ruling, a study about the relation with the recurrence and this procedure | en_US |
