dc.description | El presente trabajo de investigación tiene como objetivo determinar si las enmiendas a los artículos 229 y 326 de la Constitución, en la que se eliminaba la figura de trabajador del sector público sujetos al Código de Trabajo, constituye o no una vulneración a los derechos fundamentales laborales. Para ello se realiza un análisis doctrinario sobre los derechos de sindicación, contratación colectiva y la huelga. Si pueden ser considerados o no derechos fundamentales, la trascendencia de los convenios de la Organización Internacional del Trabajo (OIT) suscritos por el Ecuador y las garantías que debe prestar el Estado para su cumplimiento. A la vez también analizamos el sindicalismo público ecuatoriano, su influencia a lo largo de las décadas y el rol jugado en el escenario político nacional. Para entender su influencia ha sido necesario hacer un breve recuento de su origen histórico, sus procesos de conformación y su situación actual luego de que hayan quedado sin efecto las enmiendas. Finalmente se estudió el dictamen de la Corte Constitucional que daba paso al proyecto de enmiendas, así como la sentencia que las deja sin efecto. Para entender el contexto en las que se dieron fue trascendente la lectura y análisis del libro de debates de la Asamblea Nacional. Aquí se pudo determinar las posiciones contrarias a esta propuesta recogida principalmente por las centrales sindicales y movimientos de izquierda; y, la posición del ejecutivo que sostenía la necesidad de generar estas enmiendas, su argumentación y perspectiva que tienen sobre los sindicatos del sector público | en_US |
dc.description.abstract | The aim of this research work is to determine whether or not the amendments to articles 229 and 326 of the Constitution, which tried to eliminate the figure of the public sector worker who is subject to the Labor Code, are a violation of fundamental labor rights. For this purpose, a doctrinal analysis of union rights, the collective labor agreement, and the right to strike has been made. It has been also analyzed if they may be considered to be fundamental rights, as well as the significance of the agreements of the International Labor Organization (ILO) subscribed by Ecuador and the guarantees the state must present to meet them. The political role played by Ecuadorian public unionism in the national political scene and the way it has influenced throughout decades have been also analyzed. In order to understand its influence, it has been necessary to make a brief review of its historical origin, its shaping processes, and its current situation after the abovementioned amendments have ceased being in force. Finally, both the verdict of the Constitutional Court, which gave way to the draft amendments, and the sentence, which nullified them, have been studied. In order to understand the context these amendments occurred in, it was transcendental to read and analyze the discussion book of the National Assembly.
