| dc.description | El presente trabajo parte de la línea investigativa del estudio del Derecho Penal General y en forma específica de la Teoría del Delito. Dentro de ella tiene especial relevancia la conceptualización tripartita del delito con la adopción de la teoría finalista del delito. Con esta investigación se analiza uno de los temas que integran la categoría dogmática de la Culpabilidad, esto es, el error de prohibición como causa de exculpación frente a la comisión de un delito. Ello a efectos de determinar si su aplicación en el Ecuador es factible sin vulnerar el principio de legalidad, en razón de lo dispuesto en el actual artículo 34 el Código Orgánico Integral Penal. También se realiza un análisis sobre la reciente reforma contenida en la Ley Orgánica Reformatoria al Código Orgánico Integral Penal, a efectos de identificar si su próxima vigencia, cambiaría o no el escenario de la hipótesis sostenida, y es que aún sin ella, considero es posible en efecto la aplicación del error de prohibición como causa de inculpabilidad | en_US |
| dc.description.abstract | The present work is based on the research line of the study of general criminal law and specifically on the theory of crime. Of particular relevance here is the tripartite conceptualization of crime with the adoption of the finalist theory of crime. This research analyzes one of the topics that make up the dogmatic category of Guilt, that is, the error of prohibition as a cause of exoneration from the commission of a crime. This is in order to determine whether its application in Ecuador is feasible without violating the principle of legality, in accordance with the provisions of the current article 34 of the Criminal Code. An analysis is also made of the recent reform contained in the Ley Orgánica Reformatoria al Código Orgánico Integral Penal, with a view to identifying whether or not it’s coming into force would change the scenario of the sustained hypothesis, which is that even without it, I believe that it is indeed possible to apply the prohibition error as a ground for exculpation | en_US |
