En un primer momento se lo delimita, se diferencian sus clases y se revisa cómo está regulado en el Derecho ecuatoriano e internacional. En un segundo momento, se estudia la carga de la prueba en el Derecho Laboral y se centra en el despido incausado, poniendo énfasis en los despidos agravados, de reciente protección en el país.
