Abstract: | This investigation, which concerns the recall and its regulations in the Ecuadorian legal system, begins with the study of what is democracy and later on identifies its different categories, while establishing what are their characteristics and explaining the reasons why it should be considered as a mechanism of direct democracy. Likewise, a descriptive analysis is carried out on the concept of fundamental rights, trying to identify whether or not the recall constitutes a constitutional right of citizens.
To address this figure and its regulations within the national legal framework; doctrinal, historical and normative data are used, observing its development both constitutionally and legally; since its institutionalization in the Political Constitution of 1998 up to its new regulation in the Republic’s Constitution of 2008.
All of this while emphasizing reforms to the Organic Law of Citizen Participation and the Organic Electoral Law, Code of Democracy which have denatured the legal figure that serves as object of this investigation. Making this legal figure less accessible, hindering its exercise as a right and consequently, changing it to ineffective.
Finally, the jurisprudential analysis of the sentence number 001-11-SIO-CC carried out by the Ecuadorian Constitutional Court, correspondent to the case number 0005-10-IO-CC of unconstitutionality by legislative omission, due the impact of this ruling in the reforms of May 2011 to the revocation process in Ecuador. |
Description: | En el presente trabajo de investigación, relativo a la revocatoria del mandato y su regulación en el ordenamiento jurídico ecuatoriano, se inicia con un estudio sobre la democracia y sus diferentes categorías como fundamento de esta institución jurídica, estableciendo cuáles son sus características y explicando las razones por las que debe ser considerada como un mecanismo de democracia directa. Asimismo, se realiza un análisis descriptivo sobre el concepto de los derechos fundamentales, pretendiendo identificar si la revocatoria del mandato, se constituye o no en un derecho constitucional de los ciudadanos.
Para abordar a esta figura y su regulación dentro del marco jurídico nacional, se acude a datos doctrinarios, históricos y normativos, observando su desarrollo tanto constitucional como legal, desde su institucionalización en la Constitución Política de 1998 hasta su nueva regulación en la Constitución de la República de 2008, haciendo hincapié en las reformas a la Ley Orgánica de Participación Ciudadana y la Ley Orgánica Electoral, Código de la Democracia; mismas que han desnaturalizado a la figura jurídica objeto de esta investigación, tornándola menos accesible, dificultando su ejercicio como derecho y en consecuencia, volviéndola ineficaz.
Finalmente, se realiza el análisis jurisprudencial de la sentencia No. 001-11-SIO-CC dictada por la Corte Constitucional del Ecuador, correspondiente al caso No. 0005-10-IO-CC de inconstitucionalidad por omisión legislativa, en virtud de la incidencia de este fallo en las reformas de mayo de 2011 al proceso revocatorio en Ecuador. |
