| Abstract: | The following research work contains a study about the reality of the defendant and the victim within the abbreviated procedure outlined in article 635 and also of the comprenhensive Organic Criminal Code. The investigation focuses on determining if any of the guarantees that assist the procedural parts (or parties), may or may not be violated during the substantiation of this special procedure.
The present work is developed in three stages in chapters that include the respective themes: The Presumption of Innocence in the Abbreviated Procedure, The Victim in the Abbreviated Procedure; and, The Abbreviated Procedure, in the city of Cuenca.
The conclusion reached is that this special procedure directly violates the right of presumption of innocence of the defendant as the proposal is made by the prosecution, and as it is accepted by the defendant, the guarantee of no self-incrimination is indirectly violated. Regarding the right to full reparation in favor of the victim, it was determined that this guarantee is not violated. |
| Description: | El trabajo de investigación que se presenta a continuación, contiene un estudio acerca de la realidad del procesado y de la víctima dentro del procedimiento abreviado contemplado en artículo 635 y más pertinentes del Código Orgánico Integral Penal. La investigación se enfoca en determinar si alguna de las garantías que les asisten a las partes procesales, puede o no ser vulnerada durante la sustanciación de este procedimiento especial.
Para lo cual, el presente trabajo se desarrolla en tres etapas o capítulos los que engloban como temática: La presunción de inocencia en el procedimiento abreviado; La víctima en el procedimiento abreviado; y, El procedimiento abreviado, en la ciudad de Cuenca, respectivamente.
Concluyendo que este procedimiento especial, vulnera directamente el derecho de presunción de inocencia del procesado, al ser la propuesta realizada por parte de fiscalía; y, al ser esta aceptada por parte del procesado se vulnera indirectamente la garantía de no autoincriminación. En cuanto al derecho de reparación integral a favor de la víctima, se determinó que esta garantía no es vulnerada. |
