| dc.description | La actual investigación, está meditada como una manera de contribuir en algo a todas las personas que se encuentran atravesando momentos críticos con su salud tanto física y psíquica; además, este autor espera que el presente trabajo ayude a crear conciencia a todos los lectores acerca de la urgente necesidad en regular de manera legal la eutanasia en el país. A través del derecho comparado; así como por medio del discernimiento obtenido de la doctrina y revistas de ética, bioética y clínicas, se ha podido encontrar los fundamentos objetivos de carácter científico para ampliar, cambiar, fundar y por qué no; ratificar nuestro criterio en relación a la práctica de la eutanasia. Partiendo desde nuestra Constitución de la República, los ecuatorianos somos usuarios de un Estado que garantiza los derechos y la justicia, es decir, estamos asegurados por medio de un catálogo expositor de derechos, mismo que es considerado de supremacía máxima en el ordenamiento jurídico nacional. A más de aquello, los tratados internacionales de derechos humanos, robustecen los derechos de toda persona por el simple hecho de su condición humana, garantizando de esta forma la dignidad humana principalmente, pues, si las constituciones de las distintas repúblicas tienen defectos en sus textos, los tratados internacionales entran en participación directa para complementar aquellos defectos, o simplemente, para garantizar de manera más efectiva los mismos. Es a partir de esta base fundamental que hemos realizado la presente investigación; en el desarrollo de la misma, el lector irá evidenciando cuáles han sido las experiencias de los países extranjeros que han acogido en su ordenamiento legal a la eutanasia; además, se constatará como a pesar de que nuestro país no tiene un capitulo dentro de la norma penal que penalice de manera literal a la eutanasia, su práctica, si es considerada como delito. Es de esta manera como se ha planificado la investigación, con el único fin de que lo expuesto en el trabajo, sirva de alguna forma a todos los lectores que sienten en sí, la necesidad de impulsar esta propuesta con criterios objetivos y científicos por el futuro que merecen nuestros conciudadanos, amigos, familiares y algún día por el bien propio. | es_ES |
| dc.description.abstract | The current research is thought as a way to contribute something to all the people who are going through critical moments with their physical and psychological health; In addition, this author hopes that this work will help to raise awareness among all readers about the urgent need to legally regulate euthanasia in the country. Through comparative law; as well as through the discernment obtained from the doctrine and journals of ethics, bioethics and clinics, it has been possible to find the objective foundations of a scientific nature to expand, change, found and why not; ratify our criteria in relation to the practice of euthanasia. Starting from our Constitution of the Republic, we Ecuadorians are users of a State that guarantees rights and justice, that is, we are insured through a catalog of rights, which is considered the highest supremacy in the national legal system. Moreover, international human rights treaties strengthen the rights of every person by the simple fact of their human condition, thus guaranteeing human dignity mainly, then, if the Constitutions of the different Republics have defects in their texts. , international treaties enter into direct participation to complement those defects, or simply, to guarantee them more effectively. It is from this fundamental base that we have made the present investigation, in the development of it, the reader will be evidencing what have been the experiences of the foreign countries that have welcomed in their legal order to euthanasia; In addition, it will be verified as though our country does not have a chapter within the criminal law that literally penalizes euthanasia, its practice, if it is considered a crime. It is in this way that the research has been planned, with the sole purpose that what is exposed in the work, serves in some way to all readers who feel in themselves, the need to promote this proposal with objective and scientific criteria for the future They deserve our fellow citizens, friends, family and someday for their own good. | es_ES |
