| dc.description | El tema que se anhela abordar, consiste en el análisis de la proporcionalidad o no de la pena privativa de libertad impuesta en los delitos de robo con amenazas o violencias, cuando existe al menos una agravante no constitutiva de la infracción, para verificar hasta qué punto, dicha pena guarda sintonía con la Constitución. Para ello, revisamos las actas de debate de la Constitución ecuatoriana de 2008 y del Código Orgánico Integral Penal (COIP) respecto a los temas que nos atañen. Luego, consideraremos los aportes doctrinarios vertidos sobre la proporcionalidad de las penas y el delito de robo. Para finalmente, estudiar las sentencias que sobre este delito, han emitido las juezas y jueces de la Unidad Penal del cantón Cuenca, en el período comprendido entre agosto de 2014 hasta julio de 2016; y, en el caso, de los operadores jurídicos que conocieron los casos estudiados, se les realizará unas entrevistas. Este tópico, se enmarca dentro de la primera línea de investigación llamada Derecho Penal ecuatoriano, que hace parte de la sublínea Derecho Penal General, la cual contiene una sublínea más específica, denominada el principio de proporcionalidad de la pena. | es_ES |
| dc.description.abstract | The research that I will cover, consists of the analysis of the proportionality or not of the custodial sentence imposed in the crimes of robbery with threats or violence, when there is at least an aggravating circumstance not constituting the infraction, in order to verify if the penalty imposed keeps harmony with the Constitution. To do this, I will review the documents of the debate of the Ecuadorian Constitution of 2008 and the Código Organico Integral Penal (COIP) regarding the issues that concern us. Then, I will consider the doctrinal contributions that exist about the proportionality of sentences in relation to the crime of theft. Finally, I will study the judgments handed down by the judges of the Criminal Unit of Cuenca, in the period from August 2014 to July 2016; and, in the case, of the legal operators that knew the cases studied, they will be interviewed. This issue is derived from the first line of research called Ecuadorian Criminal Law, which is part of the subline General Criminal Law, which contains a more specific subline called the principle of proportionality of punishment. | es_ES |
