| Abstract: | This research work is a detailed analysis of the Ecuadorian and Spanish regulatory framework. It is centered about the water infrastructures consisting of the water reservoirs and dams; because exists a problem, although, in Ecuador these infrastructures have been built, and regulations do exist regarding them, they are insufficient and inconsistent. In the methodology, the comparative, dogmatic, exegesis, and historical method were applied. Also, as the research is analytical, it is performed with a semi-structured interview using the Delphi method. Then three professionals were selected: an expert in water reservoirs and dams, a historian and a university professor. The main results the research found were that in Ecuador there are several water infrastructures such as the water reservoirs and dams; however, the framework regulations regarding them are not consistent with the secondary regulations. There are regulatory deficiencies to regulate the efficiency and sustainability of these infrastructures. To solve the problem it was necessary to analyze and use the Spanish regulation as a reference, it was possible to identify which are the main normative elements necessary. Through this it was possible to develop a normative proposal related to these infrastructures. That then allows them to maintain the correct management and regulation of these infrastructures in the country. |
| Description: | Este trabajo de investigación realiza un análisis del marco normativo ecuatoriano y español, en torno a las infraestructuras hídricas denominadas embalse y presa; pues existe una problemática latente ya que, si bien en el Ecuador dichas infraestructuras han sido construidas, y al existir normativa referente a las mismas, esta resulta ser insuficiente e incongruente. Metodológicamente se utilizó el método comparativo, dogmático, la exégesis e histórico, además, ya que la investigación es de tipo analítica, se realizó entrevistas utilizando el método Delphi, en el cual se eligió tres actores: un experto en embalses y presas, un historiador y un académico. Los principales resultados que la investigación encontró fue que en el Ecuador, existen varias infraestructuras hídricas como lo son los embalses y las presas; sin embargo, la normativa marco referente a los mismos no es congruente con la secundaria, así como existen deficiencias normativas para regular la eficiencia y sostenibilidad de dichas infraestructuras. Para solucionar dicho problema, fue necesario establecer como base a la normativa española, pues al analizar y tomar como referencia su marco normativo se pudo identificar cuáles son los principales elementos necesarios que garanticen un normativa sostenible, y a través de esto se logró desarrollar una propuesta normativa relativa a dichas infraestructuras que permita mantener el correcto manejo y regulación de las mismas en el país. |
