| Abstract: | The present investigation studies the crime typified in the Integral Organic Penal Code of Psychological Violence against Women and Members of the Family Nucleus. Its main objective was to demonstrate if the criminal type of psychological violence is effective.
For this purpose, field information was collected from the three specialized gender units of the Provincial Prosecutor's Office of Azuay, due to the fact that in this province the highest figures of gender violence are presented in Ecuador. With respect to the temporary scope, the cases of the period corresponding from August 14, 2014. (When the Code was in effect) until December 31, 2016 were analyzed.
From the analysis of the cases it was possible to clearly identify the legal problems and the difficulty of the evidence presented by the fiscal investigations, verifying the large number of complaints and that only 0.01% of reported cases of psychological violence have a conviction. Therefore, it is concluded that the conforming criminal type is ineffective |
| Description: | La presente investigación estudia el delito tipificado en el Código Orgánico Integral Penal de Violencia Psicológica contra la Mujer y Miembros del Núcleo Familiar. Su objetivo principal fue demostrar si el tipo penal de violencia psicológica es eficaz.
Para ello se recopiló información de campo de las tres unidades especializadas de género de la Fiscalía Provincial del Azuay, debido a que en esta provincia se presentan las cifras más elevadas de violencia de género en el Ecuador. Con respecto al ámbito temporal, se analizaron los casos del periodo correspondiente al 14 de agosto del 2014 (entrada en vigencia del Código) hasta el 31 de diciembre del año 2016.
Del análisis de los casos se pudo identificar claramente los problemas jurídicos y la dificultad de la prueba que presentan las investigaciones fiscales, verificando el gran número de denuncias y que tan solo el 0.01% de los casos denunciados de violencia psicológica tienen una sentencia condenatoria. Por lo que se concluye que el tipo penal conforme se encuentra regulado es ineficaz |
