| dc.description | El presente trabajo analiza la figura de la responsabilidad penal de la persona jurídica en el delito contra la propiedad intelectual, análisis que parte de la evaluación delas conductas penalmente relevantes que atentan contra la propiedad intelectual en el Ecuador. El trabajo busca establecer si su tipificación, que gira únicamente en torno a los derechos de autor y las marcas de productos, tiene algún fundamento, ya que el tipo penal no fue originalmente incorporado en el Código Orgánico Integral Penal COIP en el año 2014, y tuvo que ser incorporado mediante reforma planteada en el años 2015.Dentro de la citada reforma se incluyó la posibilidad de responsabilizar penalmente a personas jurídicas, analizando en este aspecto, el sistema de imputación que se aplicaría en el Ecuador. | es_ES |
| dc.description.abstract | In this document we analyze the figure of the criminal responsibility of the juridical person in the crime against the intellectual property, analysis that starts from the evaluation of the criminally relevant conduct against the intellectual property in Ecuador. The work seeks to establish if the penal type, which is established around copyrights and product brands, has some basis, considering that the criminal type was not originally incorporated into the Código Orgánico Integral Penal COIP in 2014, and it had to be incorporated through a reform proposed in 2015.
