dc.description | El Código Orgánico Integral Penal (COIP) fue publicado en el año 2014 con la intención de concentrar en un solo cuerpo la normativa penal sustantiva y adjetiva, así como para adaptar los tipos penales a las nuevas realidades. El Código Penal (1971) incorporó por primera vez un catálogo de delitos ambientales desde la reforma realizada en el año 2000, como consecuencia del reconocimiento de la Pachamama como sujeto de derechos en la Constitución de 1998. El principal acierto de la normativa previa al COIP era la consideración de los delitos ambientales como delitos de peligro, pues no se necesitaba un daño materializado para perfeccionar el tipo penal. Con la publicación del COIP se pretendía mejorar o al menos igualar este nivel de protección ambiental; sin embargo, el catálogo de delitos ambientales del COIP ha significado una regresión normativa por dos problemas principales: a) los delitos ambientales han dejado de ser delitos de peligro, por lo que determinados tipos penales requieren la materialización del daño; y b) se presentan normas en blanco que remiten la determinación de ciertas figuras del tipo a autoridades administrativas para la configuración del mismo | es_ES |
dc.description.abstract | The Código Orgánico Integral Penal (COIP) was published in 2014 with the purpose of concentrating in one codex the substantive and adjective norm, and also to adapt the criminal law to our new reality. The former Código Penal (1971) incorporated for the first time a catalogue of environmental crimes since the reform of 2000, as a consequence of the recognition of Pachamama as a subject of rights in our 1998 Constitution. The main success of the norm prior to COIP was the consideration of environmental crimes as crimes of danger, so it was not necessary to verify materialized damage to perfect the penal type. With the publication of COIP the aim was to improve or at least to match the former level of environmental protection; however, the catalogue of environmental crimes has signified a normative regression because of two main reasons: a) environmental crimes are no longer crimes of danger, therefore certain crimes require the materialization of the damage; b) there are blank norms that remit the determination of certain figures of the type to administrative authorities for the configuration of it | es_ES |
