| dc.description | El presente trabajo de titulación contiene un análisis del artículo 640 del Código Orgánico Integral Penal, el cual regula las reglas del Procedimiento Directo, en el que además se analiza si el mismo cumple con las garantías básicas del debido proceso, especialmente el derecho a la defensa, el derecho a contar con el tiempo prudencial para preparar la defensa, el principio de igualdad de armas, entre otros. De la misma manera se analizará los procesos judiciales aplicados mediante este procedimiento especial en los que se verificarán si cumple con los parámetros constitucionales e internacionales referidos en el párrafo anterior. Por último se realizarán varias entrevistas a fiscales, jueces y abogados litigantes con la finalidad de conocer sus criterios al respecto y de esta manera brindar una conclusión que satisfaga el objetivo de esta investigación. | es_ES |
| dc.description.abstract | This research paper contains an analysis of the article 640 of Integral Criminal Code (COIP) which regulates the rules of the direct procedure, which also analyzes if it complies with the basic guarantees of due process, especially the right to defense, the right to have reasonable time to prepare the defense, the principle of equality of arms, among others. In the same way, the aim of this research paper is analyze the judicial processes applied by this special procedure in which it will be verified if it complies with the constitutional and international parameters referred to in the preceding paragraph. Finally, there will be several interviews to prosecutors, judges and trial lawyers in order to know their criteria and generate a conclusion that satisfies the objective of this investigation. | es_ES |
