dc.description | Los contribuyentes, al ser sujetos pasivos de la relación jurídico tributaria, están en la obligación de contribuir con el Estado; aporte que encuentra mayor eficacia en el derecho que tiene la administración tributaria a la información. Sin embargo, aquel derecho encuentra su límite en el conocido derecho a la intimidad que el contribuyente posee. Para una mejor comprensión, empezaremos exponiendo los conceptos de los diferentes doctrinarios, tanto del derecho a la intimidad cuanto del derecho a la información; así como también de la forma en la que la legislación española y parte de la legislación latinoamericana, protegen dichos derechos. Además expondremos a cerca del amparo legal a la intimidad e información que nos ofrece el ordenamiento jurídico ecuatoriano. Abordaremos el tema del derecho constitucional tributario con el objetivo de adquirir un conocimiento más amplio y concreto de los derechos fundamentales a estudiar; analizaremos también la figura jurídica constitucional del “habeas data”, como el recurso idóneo que el Ecuador ofrece a sus contribuyentes para la defensa de su derecho a la intimidad. Por otra parte, analizaremos detenidamente, según el Código Tributario, las facultades que la Administración Tributaria tiene para la obtención y registro de datos de sus contribuyentes. Presentaremos las diversas teorías acerca de la prevalencia del derecho a la intimidad sobre el derecho a la información y viceversa, así como la teoría de la ponderación de derechos. Finalmente realizaremos un análisis de la importancia de estos derechos para cada una de las partes. | es_ES |
dc.description.abstract | Taxpayers, being passive subjects of the legal tax relationship, are obliged to contribute to the Ecuadorian State regulations; contribution that finds a major effectiveness in the right that the tax administration has to receive information. However, that right finds its limitation in the known right to privacy that the taxpayer owns. For a better understanding, we will begin exposing the concepts of different doctrinaires, both of the right to privacy and of the right to information; as well as of the way in which the Spanish legislation and part of the Latin American legislation, protect these rights. Besides, we will expose the legal protection of the privacy and information offered by Ecuadorian legal system. We will focus on the issue of the constitutional tax law with the purpose of acquiring a broader and concrete knowledge of the fundamental rights to study; will also analyze the constitutional legal figure of “habeas data”, as the ideal resource that Ecuador offers its contributors for defenders their right to privacy. On the other hand, we will analyze carefully, according to the Tax Code, the capacity that the Tax Administration has for obtaining and registering their taxpayers data. We will present the different theories about the prevalence of the right to privacy on the right to information and vice versa, as well as the theory of the weighting of rights.
