| dc.description | El presente trabajo de investigación tiene por objeto el estudio de las Empresas Públicas, su naturaleza jurídica, su evolución, el tratamiento a partir de la Constitución de Montecristi, posteriormente el desarrollo que tuvo con la Ley Orgánica de Empresas Públicas. Como base fundamental de estudio y análisis de este trabajo es el régimen tributario aplicable a las empresas públicas, al ser un tema actual e innovador en la legislación ecuatoriana, por la importancia que tiene en la economía del país, y esta por encontrarse íntimamente ligada con el derecho no se podía obviar su estudio desde el punto de vista jurídico, por lo cual se hace un análisis de las empresas públicas como sujeto activo; posteriormente como sujeto pasivo, a que tributos se encuentra sujeto o exento, su operación como agente de retención. Finalmente, se hace un desenlace con un análisis comparativo con la legislación de Colombia y la legislación de Argentina sobre régimen fiscal de las empresas públicas en dichos países, enfocándonos principalmente en el tratamiento del Impuesto a la Renta y el Impuesto al Valor Agregado respecto de las empresas públicas. | es_ES |
| dc.description.abstract | The purpose of this research is to study Public Companies, their legal nature, their evolution, the treatment based on the Constitution of Montecristi, and subsequently the development that it had with the Organic Law of Public Companies. As a fundamental basis of study and analysis of this work is the Tax Regime applicable to public companies, being a current and innovative topic in Ecuadorian legislation, because of the importance that it has in the country's economy, and it is closely linked with the law it could not be neglected from the legal point of view, so an analysis of public companies as an active subject is done; subsequently as a passive subject, to which taxes it is liable or exempt, its operation as a retention agent. Finally, a denouement is made with a comparative analysis with the legislation of Colombia and the legislation of Argentina about fiscal regime of the public companies in those countries, focusing mainly on the treatment of the Income Tax and Value Added Tax with respect to the public enterprises. | es_ES |
