| dc.description | El Estado a través del poder legislativo día a día elabora un sistema jurídico que se adapta a los constantes cambios que se dan en la sociedad, la cual por su dinamismo, evoluciona a pasos agigantados. Uno de los principales tópicos a ser tratados, corresponde el tipificar delitos y aplicar sanciones para aquellas personas que incurren en conductas que no son toleradas por el núcleo social. El principal discurso que maneja el Estado, es el de máxima aplicación del poder punitivo, particular que día a día toma fuerza y es legitimado, aceptado e inclusive solicitado por la colectividad en general, al considerar que se vive en un constante estado de inseguridad y peligro. Sin embargo, es necesario tener en cuenta que la aplicación de penas severas, lo que hace es dar un control y total dominio del poder al Estado y por ende al Gobierno de turno, ya que, al entregarles estas prerrogativas, este poder se desborda y no puede ser controlado oportunamente, lo que genera desviaciones de las cuales se verán perjudicados no solo los presuntos infractores, sino también el ciudadano común. | es_ES |
| dc.description.abstract | The state legislature every day elaborates a law system which is adapted to the constant changes of society, which by its dynamism evolves by leaps and bounds. One of the main topics to be discussed, it is the criminalization of some conducts and the sanctions for those behaviors that are not tolerated by the social nucleus. The state speech is the maximum application of punitive power. It every day takes strength and is legitimized accepted and even requested by the people who consider that they live in a constant state of insecurity and danger. However, we should consider that the application of severe penalties, involve the control and domination of power of the state and therefore the government. Consequently by giving these prerogatives to the state, the power overflows and it generate deviations which could cause a damage to the alleged infringer and citizens. | es_ES |
