| Abstract: | The Chain of Custody is considered a fundamental element in criminal proceedings, since it depends on the validity that the judge comes to give the evidence presented to him at the time of the trial, as we know, all those samples , Evidence, that has been collected at the place of the facts, will acquire the value of evidence, only when they have been obtained legally, that is, subject to what is established in the Constitution and the law, As long as they are not adulterated during the course of the chain of custody, and it is therefore important that all those officials, agencies, who are in charge of the chain of custody, must be fully qualified to perform their duties in a manner Responsible, knowing that it depends on them that the evidence, can arrive before the judge without any alteration and therefore is a valid proof to demonstrate the existence A of criminal responsibility processed.
Thus, it is of paramount importance that the various stages that form the chain of custody are carried out with full compliance with what is regulated by the law, so that, at the time of the presentation of the evidence, the opposing party can not plead Nullity of the same because they were not in the same state they were when they were collected at the scene. The Judicial Police, the Prosecutor's Office and all those responsible for the chain of custody must carry out their duties without any negligence, so that they are not involved in responsibilities that may be administrative, civil and even criminal. |
| Description: | La Cadena de Custodia, es considerada un elemento fundamental dentro de los procesos penales, puesto que, de ella depende la validez que el juzgador llegue a darle a las evidencias que se le presenten en el momento del juicio, pues como sabemos, todas aquellas muestras, vestigios, evidencias, que hayan sido recolectadas en el lugar de los hechos, adquirirán el valor de prueba, únicamente cuando las mismas hayan sido obtenidas de manera legal, es decir, con sujeción a lo que establece la Constitución y la ley, así, también, siempre y cuando no sean adulteradas durante el transcurso de la cadena de custodia, y por ello, es importante que todos aquellos funcionarios, organismos, que están encargados de la cadena de custodia, deben estar plenamente capacitados para poder desempeñar sus funciones de manera responsable, sabiendo que de ellos depende que las evidencias, puedan llegar ante el juez sin ninguna alteración y por lo tanto sea una prueba válida para demostrar la existencia de la responsabilidad penal procesado.
De este modo, es de suma relevancia, que las distintas etapas que conforman la cadena de custodia sean llevadas a cabo con total cumplimiento a lo que regula la ley, para que, al momento de ser presentadas las pruebas, la parte contraria no pueda alegar nulidad de las mismas por no encontrarse en el mismo estado que estaban cuando fueron recolectadas en el lugar de los hechos.
La Policía Judicial, la Fiscalía y todos aquellos organismos responsables de la cadena de custodia, deben cumplir sus funciones sin negligencia alguna, para que no se vean involucrados en responsabilidades que pueden se tanto administrativas, civiles e incluso penales. |
